1. ABOUT THESE TERMS

Welcome to Valaura Active. These Terms & Conditions (“Terms”) apply when you access or use valauraactive.com (the “Website”) or purchase products from Valaura Active.

In these Terms, “Valaura Active”, “Valaura”, “we”, “us” and “our” refer to Valaura Active, a trading name of Ella Murray, a sole trader.

By using our Website or placing an order with us, you agree to these Terms. Please read them carefully before placing an order.

These Terms should be read together with our:

Nothing in these Terms affects any legal rights you have as a consumer that cannot legally be excluded or restricted.

2. ABOUT VALAURA ACTIVE

Valaura Active is an online activewear retailer selling clothing and related products to customers in the UK and selected international destinations.

Our business is currently operated as a sole trader business under the trading name Valaura Active.

3. USING OUR WEBSITE

You may use our Website for lawful purposes only.

You must not:

  • use the Website for fraudulent or unlawful purposes;
  • attempt to gain unauthorised access to our Website or systems;
  • interfere with the operation or security of the Website;
  • knowingly introduce viruses, malware or other harmful material;
  • copy, reproduce, modify or distribute our Website content without permission;
  • use automated systems to scrape, reproduce or collect our content without our written permission;
  • impersonate another person or provide false information; or
  • use our Website in a way that could damage Valaura Active or interfere with another customer's use of the Website.

We reserve the right to restrict or terminate access to the Website where we reasonably believe these Terms have been breached.

4. OUR PRODUCTS

We make every reasonable effort to ensure that product descriptions, photographs, colours, measurements and other information on our Website are accurate.

However, colours may appear slightly different depending on your device, screen settings and lighting.

Product availability may change at any time. We may limit quantities available for purchase and may discontinue products without notice.

If a product becomes unavailable after you have placed an order and we are unable to fulfil it, we will contact you and provide a full refund for the unavailable product.

5. PRODUCT SIZING

Sizing information is provided as a guide and is available on the relevant product pages.

Our activewear is designed using stretch fabrics, and the fit may vary depending on the style and the customer's preferred fit.

Please refer to the individual product's size guide before ordering.

Where a product page provides specific sizing recommendations, these should be followed.

6. PLACING AN ORDER

When you place an order through our Website, you are making an offer to purchase the products in your basket.

You are responsible for ensuring that all information provided during checkout is accurate, including your name, email address, delivery address and payment details.

After placing your order, you will receive an order confirmation email acknowledging that we have received your order.

Your order will be accepted when we confirm that the products have been dispatched, or otherwise expressly confirm acceptance of your order.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • there is an obvious pricing or product description error;
  • we suspect fraudulent or unauthorised activity;
  • there has been an error in stock availability; or
  • we are unable to fulfil the order.

If we cancel an order after payment has been taken, you will receive a full refund of the amount paid.

7. CANCELLING AN ORDER BEFORE DISPATCH

If you wish to cancel your order before it has been dispatched, please contact us as soon as possible at ella@valauraactive.com.

We will do our best to accommodate cancellation requests received before dispatch.

Once an order has been dispatched, we may be unable to cancel it before delivery. In this situation, you may exercise your applicable cancellation and return rights described in our Returns Policy.

8. PRICES AND PAYMENT

All product prices displayed on our Website are in British Pounds Sterling (£).

The price payable for a product is the price displayed at the time you place your order, unless there is an obvious pricing error.

Applicable UK taxes are included in displayed prices where required.

Delivery charges are shown separately during checkout.

We accept payment methods made available through Shopify's checkout, which may include card payments, Apple Pay, Shop Pay, Klarna and other available payment methods.

Payment must be successfully authorised before an order can be processed.

9. INTERNATIONAL ORDERS — CUSTOMS, IMPORT DUTIES AND TAXES

IMPORTANT — PLEASE READ BEFORE PLACING AN INTERNATIONAL ORDER

For orders delivered outside the UK, you are responsible for any customs duties, import taxes, VAT, customs clearance fees, handling charges or other charges imposed by the destination country.

These charges are not included in the price you pay to Valaura Active unless we expressly state otherwise at checkout.

Valaura Active does not control these charges and cannot predict the exact amount that may be payable.

Any such charges are the responsibility of the customer and must be paid directly by the customer or to the relevant customs authority, courier or other applicable party.

Valaura Active will not reimburse or refund customers for customs duties, import taxes, VAT, customs clearance fees, handling charges or similar charges imposed by the destination country.

Customers are responsible for checking the applicable import requirements and charges in their country before placing an order.

10. SHIPPING AND DELIVERY

UK standard delivery is £3.99 and is sent using Royal Mail Tracked 48.

Delivery is generally expected within 3–5 business days, although delivery times are estimates and can occasionally take longer.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, customs processing, severe weather, strikes or other events outside our control.

However, nothing in these Terms limits your statutory rights where goods fail to arrive within the legally required timeframe.

11. RETURNS AND REFUNDS

We offer a 30-day returns period for eligible products, subject to the conditions set out in our Returns Policy.

Returned items must generally:

  • be unused;
  • be unworn;
  • show no signs of wear;
  • have all original tags attached; and
  • be returned in an appropriate condition.

Customers are responsible for the cost of returning unwanted items unless otherwise stated or where the item is faulty or we are legally required to cover the cost.

We currently offer refunds rather than exchanges.

Certain products, including underwear, may not be eligible for return for hygiene reasons, except where the law requires otherwise.

Your statutory cancellation rights

For most online purchases, UK consumers have statutory cancellation rights that apply separately from our 30-day returns policy.

You generally have 14 days from the day after receiving your goods to tell us that you wish to cancel, followed by a further 14 days to return the goods.

Where statutory cancellation rights apply, we will refund the applicable amount in accordance with UK consumer law.

12. FAULTY OR DAMAGED PRODUCTS

We want every Valaura Active order to arrive in excellent condition.

If you believe your item is faulty, damaged or not as described, please contact us at ella@valauraactive.com as soon as reasonably possible.

Please provide:

  • your order number;
  • a detailed explanation of the issue; and
  • clear photographs showing the fault or damage.

We may request additional information where necessary to assess the issue.

Nothing in these Terms affects your statutory rights relating to faulty, damaged or misdescribed goods.

13. SALE ITEMS, FLASH SALES AND PROMOTIONS

We may offer promotional pricing from time to time, including flash sales, launch offers, bundle deals and discount codes.

Promotions may have their own terms, conditions, expiry dates, stock limitations or eligibility requirements.

Unless otherwise stated:

  • only one discount code may be used per order;
  • discount codes cannot be combined;
  • promotional prices apply only during the advertised promotional period; and
  • promotions are subject to availability.

Refunds on promotional purchases

Where a customer returns a product purchased as part of a promotion, bundle or sale, any refund will be based on the amount actually paid for the returned item, rather than its full-price value.

Where an offer includes a free product or item, the return conditions of the relevant promotion will apply. Where the promotional structure means that a returned item was provided free of charge, no monetary refund will be due for that free item.

Customers will not lose any statutory rights as a result of purchasing a sale or promotional item.

14. DISCOUNT CODES

Unless otherwise stated:

  • only one discount code can be used per order;
  • discount codes cannot be combined;
  • discount codes may have expiry dates or specific eligibility requirements;
  • discount codes cannot be exchanged for cash; and
  • we reserve the right to cancel or withdraw a discount code where it has been used fraudulently, incorrectly or contrary to its terms.

15. INTELLECTUAL PROPERTY

All original content on the Website belongs to Valaura Active or is used with permission.

This includes, but is not limited to:

  • the Valaura Active name and branding;
  • logos;
  • product designs;
  • product photography;
  • website photography;
  • product images;
  • graphics;
  • written content;
  • descriptions;
  • videos;
  • marketing materials; and
  • the overall design and presentation of the Website.

You may view and use our Website for your own personal, non-commercial purposes.

You must not copy, reproduce, modify, distribute, sell, republish or commercially use our content without our prior written permission.

The Valaura name and associated branding are subject to our intellectual-property rights and applications. Nothing in these Terms should be interpreted as granting you permission to use our branding.

16. THIRD-PARTY SERVICES AND LINKS

Our Website may use third-party services and may contain links to third-party websites, including payment providers, delivery providers, social media platforms and other services.

We are not responsible for the content, availability, security or practices of third-party websites.

Your use of third-party services may also be subject to their own terms and policies.

17. SHOPIFY

Our online store is powered by Shopify.

Shopify provides the e-commerce platform that allows us to sell our products to you.

However, your purchase contract is with Valaura Active, not Shopify.

Shopify is not responsible for the products we sell or for the fulfilment of your order.

18. PRIVACY

We collect and use personal information in accordance with our Privacy Policy.

By using our Website and placing an order, you acknowledge that your personal information will be processed as described in our Privacy Policy.

Because our Website is powered by Shopify and may use other third-party service providers, your information may be processed by those providers where necessary to operate our Website, process payments, fulfil orders, provide delivery services, communicate with you and otherwise provide our services.

19. CUSTOMER REVIEWS AND FEEDBACK

If you submit reviews, comments, photographs, suggestions or other feedback to Valaura Active, you confirm that you have the right to provide that content and that it does not infringe the rights of another person.

By submitting content to us, you grant Valaura Active permission to use, reproduce and display that content for legitimate business, marketing and promotional purposes, subject to applicable law.

We may remove content that we reasonably believe is unlawful, misleading, offensive, fraudulent, abusive or otherwise inappropriate.

We do not guarantee that customer reviews or other submitted content will remain published.

20. ERRORS AND CHANGES

We try to ensure that information on our Website is accurate.

Occasionally, there may be errors relating to:

  • product descriptions;
  • prices;
  • promotions;
  • stock availability;
  • delivery charges; or
  • other Website information.

Where an obvious error occurs, we reserve the right to correct it.

If an obvious pricing or product error affects an order you have placed, we will contact you where reasonably possible and, where appropriate, give you the option to cancel the affected order.

We may also update product information, pricing, availability and Website content from time to time.

21. LIABILITY

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

This includes liability for matters such as death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to goods that are faulty, unsafe or not as described.

We are not responsible for losses that arise from matters outside our reasonable control.

To the extent permitted by law, Valaura Active will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was formed.

Nothing in these Terms affects your rights as a consumer under applicable UK consumer law.

22. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control.

This may include, for example:

  • natural disasters;
  • severe weather;
  • strikes;
  • industrial disputes;
  • government action;
  • interruption of transport services;
  • internet or telecommunications failures;
  • carrier disruption;
  • customs delays; or
  • other events outside our reasonable control.

Where reasonably possible, we will keep you informed of significant delays.

23. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The latest version will always be available on this page and will show the date it was last updated.

Changes will not affect an order you have already placed where doing so would conflict with your legal rights.

24. GOVERNING LAW

These Terms and any dispute arising from your use of the Website or purchase of our products will be governed by the laws of England and Wales.

If you are a consumer, you will also benefit from any mandatory consumer protections that apply to you under the laws of the country in which you live.

Nothing in these Terms prevents you from relying on mandatory consumer rights that cannot legally be excluded.

25. SEVERABILITY

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as removed or modified to the minimum extent necessary, and the remaining provisions will continue to apply.
